Purpose
These Terms of Service (“Terms”) govern access to and use of the Bailor service, published by Biz Tech Services, which comprises: the Bailor Pro application, intended for landlords and property managers; the Bailor application, intended for tenants; the bailor.app website and its related services.
By creating an account or using the Service, you accept these Terms without reservation. If you do not accept them, do not use the Service.
Description of the Service
Bailor is a rental management tool: creating and tracking leases, generating lease agreements, issuing rent invoices, recording collections (cash and mobile money), producing receipts and rent receipts, due-date reminders and dashboards.
Bailor is a tool, not a party to the lease. The tenancy agreement binds the landlord and the tenant exclusively. Biz Tech Services is neither a landlord, nor a real-estate agent, nor a debt-collection agent, and does not intervene in tenancy disputes.
Accounts
- Registration requires accurate, up-to-date information (identity, phone, e-mail). You are responsible for its accuracy.
- Your credentials, PIN code and one-time codes (OTP) are strictly personal. Any operation carried out from your account is deemed to have been performed by you.
- You must notify us without delay of any unauthorised use of your account.
- Users must be of legal age and have legal capacity.
Landlord roles and responsibilities
A landlord (or manager) using Bailor Pro:
- warrants that they have the right to rent out the properties they register;
- is solely responsible for the accuracy of the information entered (rents, charges, tenant identities) and for the compliance of their leases with applicable law;
- undertakes to collect their tenants’ personal data lawfully and to use it exclusively for rental management;
- remains solely responsible for their tax and reporting obligations.
Payments and money
- Cash payments are recorded by the landlord in the application; Bailor records the operation but does not handle the funds.
- Mobile money payments are processed by licensed payment operators; Biz Tech Services is not a payment institution and does not hold users’ funds.
- Generated documents (invoices, receipts, rent receipts) reflect the operations recorded in the Service. In the event of an input error, the landlord has traceable correction tools (reversal entries); documents are never retroactively altered.
Subscription and pricing
The Bailor application (tenants) is free. Bailor Pro is offered according to the price list published at bailor.app/pricing, which may change with reasonable notice given in the application. Non-payment of the subscription may lead to the suspension of paid features, without loss of data already recorded.
Prohibited uses
It is prohibited to use the Service to: register fictitious properties or leases; produce misleading documents (fake rent receipts, fake receipts); harass a tenant or a landlord through the notification channels; bypass security, probe or overload the infrastructure; resell access to the Service without written agreement.
Any breach may lead to the suspension or deletion of the account, without prejudice to any legal proceedings.
Data and documents
- Your data belongs to you. You can export your documents (PDF) at any time.
- Issued documents (agreements, invoices, receipts, rent receipts) are kept and timestamped for evidentiary and audit purposes; recorded financial operations are never deleted, only reversed.
- If the account is closed, data is retained and then deleted in accordance with the Privacy policy.
Availability and evolution of the Service
We aim for maximum availability but do not guarantee uninterrupted operation (maintenance, outages, networks). The Service evolves continuously; features may be added, modified or removed with reasonable prior notice where the change is substantial.
Liability
To the extent permitted by law, Biz Tech Services’ liability is limited to proven direct damages and capped at the subscription amounts paid over the last twelve months. Biz Tech Services is not liable for: disputes between landlords and tenants; users’ input errors; unavailability attributable to telephone operators, payment services or the host; force majeure events.
Termination
You may close your account at any time from the application or by writing to hello@bailor.app. We may suspend or terminate an account in the event of a breach of these Terms, with reasoned notice except in urgent cases.
Changes to these Terms
We may amend these Terms. Substantial changes are notified in the application at least 15 days before they take effect. Using the Service after that date constitutes acceptance.
Governing law and jurisdiction
These Terms are governed by the laws of Cameroon. Failing amicable resolution, the competent courts of Douala have exclusive jurisdiction, unless a mandatory provision of the user’s country of residence provides otherwise.
